The Tale of the Pious Robber. (Tagur 15)

It is narrated that one night, the District Judge of Anthaqia left the house and went to his garden. After he reached outside the village, he was confronted by a robber. The robber rebuked, "Take off everything you are wearing. Otherwise, I will do it by force." The judge replied, "May Allah strengthen your faith. Truly a person of knowledge has an honorable position. And I am a judge in this country, so respect me."

The robber replied, "Praise be to Allah Who has brought me to you. Because I believe you have many clothes and mounts while the other person may be a weak person (his condition) and the poor have nothing." The judge said, "I see you are a man of knowledge." The robber said, "Yes, and above the knowledgeable person there is always someone who exceeds his knowledge."

The judge said, "Do you not know the hadith narrated from the Messenger of Allah: "Religion belongs only to Allah, the servants are Allah's servants and the sunnah is my sunnah. Whoever commits bid'ah, Allah will curse him." Beheading and robbing is an act of heresy and I warn you not to fall into the curse." The robber said, "O judge, this hadith is a mursal hadith, not narrated from Nafi' from ibn Umar. If I accept that the narrators of this hadith are fair or I accept that this hadith is qath'i, then what do you think about the robbers who spy on you? Robbers who have neither food nor anything sufficient for them. What you wear is lawful for me. Indeed Imam Malik has narrated from Nafi' from Ibn Umar that the Messenger of Allah said, "If this world were a flood of blood, the food of the Muslims would be lawful. " And there is no difference of opinion among the scholars that it is obligatory for a person to support himself and his family with other people's property if he is afraid of perishing. And I - by Allah - am among those who worry about my destruction. So, what you use is the source of life for me and my family. So, leave the matter to me and you will be able to leave safely."
