Is Smoking Banned?
Is shop banned?
My answer is yes
Because I have read articles that contain:
Tobacco which is a raw material for cigarettes was known by Muslims at the end of the 10th century Hijriyah, which was brought by Spanish traders. Since then the Muslims began to recognize cigarettes. Some think that smoking is legal.
They postulate that all original laws change unless there is an argument forbidding them, according to the word of God:
هُوَ الَّذِي خَلَقَ لَكُمْ مَا فِي الْأَرْضِ جَمِيعًا
"He is Allah, Who made everything on earth for you." (Surah Al Baqarah: 29).
The above verse explains that everything created by God on this earth is lawful for humans, including tobacco which is used as raw material for cigarettes.
Disclaimer:
Arguing with this verse is not strong, because everything created by God is lawful if it does not contain things that damage and harm the body.
While cigarettes contain thousands of poisons that have been proven medically harmful and dangerous to health. It even kills its users slowly, even though Allah has said:
وَلَا تَقْتُلُوا أَنْفُسَكُمْ إِنَّ اللَّهَ كَانَ بِكُمْ رَحِيمًا
"And do not kill yourself; surely Allah is the Most Merciful to you. "(Surat an-Nisaa: 29).
I can analyze that the shop is indeed very dangerous for the users of the shop or those who breathe the cigarette smoke.
There are also some scholars who say that cigarettes are lawful because this is said in the time of the Prophet sallallaahu ‘alayhi wa sallam, explained in his saying with (HR. Muslim)
The refutation of this analogy is clearly not strong in cigarettes said to be makruh, because the impact of shops is no longer just the unpleasant odor of cigarette smoke that has bad breath in use, no longer a problem of unpleasant odor but there is a cause of disease in the lungs, talk about disease and health, we can look back again in the time of the Prophet that there were very limited scholars in the past that there was an impact on health as well, because they saw only the outside, namely the impact of bad breath that disturbs others, this is a limitation in Rosulallah era because it is not as sophisticated as today to examine how dangerous it is for active user shops,
Eating it is said to be makruh.
And there are also those who continue to emphasize that the shop is indeed forbidden it is confirmed by Qalyubi (Shafi'i Scholars, died: 1069 H). In the book Hasyiyah Qalyubi a la Syarh al-Mahalli (volume I, page 69), he said: "Marijuana and all drugs that eliminate reason, the substance is sacred even though it is forbidden to consume, therefore our scholars believe that the legal cigarettes are also haram , because smoking can open the way for the body to contract various dangerous diseases ".
Those are some of the arguments and opinions of the scholars who insha allah will strengthen part of my opinion
Yes, that's how it is when talking about roko, haram or not there is no longer have to continue to study because the majority of the earth is active shopper
